Some people ask what’s the difference between a Will, Power of Attorney and a Living Will.
Will: it only takes effect upon your death. It’s where you designate who gets what from your estate. Another important feature is the guardianship provision. If you have minor children, this is important. In a will, you designate who would assume care of your kids. Otherwise, the government decides.
Power of Attorney: you designate someone to act on your behalf for all financially related decisions. If you become ill, or worse incapacitated, who would pay your bills, for example. Take control and name a power of attorney or risk the government choosing for you.
Living Will/ Health Care Power of Attorney: you designate someone to act on your behalf for all health-care related decisions. If you become ill or incapacitated, someone has to make medical decisions for you. Put yourself in control of what happens to you if you are suddenly put on a ventilator, for example.
